Abinanti Law Bans Undetectable Firearms

Assembly member Abinanti passed New York’s first Ghost Gun Ban which law bans the manufacture, possession, or transfer of an undetectable firearm or components.

Red Flag

Assembly member Abinanti voted for the Extreme Risk Protection Law to keep guns out of the hands of those who exhibit “red flag” behaviors. It authorizes judges to issue an Extreme Risk Protection Order (ERPO) to take guns away from persons deemed a threat to themselves or others.

Background Checks 30 Day

Assemblyman Abinanti voted for New York’s thirty-day law which expanded to thirty days the time for a background check before a gun can be sold to an individual. Previously, a gun sale could be delayed only three days even if the individual was not yet approved by the federal background check.

Mental Health Records

Assemblyman Abinanti voted for the New York law that requires out-of-state citizens to waive the confidentiality of their home state mental health records in order to apply for a New York State gun license.

Bump Stock Device

Assemblyman Abinanti voted for New York’s law prohibiting the sale or possession of a bump stock — a firearm attachment that accelerates the firing rate of a semi-automatic weapon to mimic the effects of an automatic weapon or machine gun.

No Guns at Schools

Assemblyman Abinanti voted for New York’s law prohibiting school administrators from arming teachers or other school employees in K-12 schools in New York.

Gun Buy-Back Program

Assemblyman Abinanti voted for the Municipal Gun Buyback Program to get guns off the streets. The program allows individuals to turn in firearms in exchange for a monetary reward and immunity from certain criminal possession charges.

Safe Act

Assemblyman Abinanti voted for New York’s comprehensive Secure Firearms and Ammunition Enforcement Act (SAFE Act) that: (1) bans new assault weapons and requires permits for those in the state on the effective date; (2) requires pistol permits to be renewed every five years; (3) closes the “gun show loophole”; (4) requires background checks on all gun and ammunition purchases; (5) revokes pistol permits for domestic violence abusers; and (6) attempts to ensure that those with mental illness do not have access to firearms.

Westchester Gun Violence Prevention Laws

When he was a county legislator, the Westchester Legislature approved and the State Legislature passed a
State law enacting Abinanti’s proposals to require:

  • Removal of perpetual handgun licenses in Westchester County and require they must be renewed periodically.
  • All prospective Westchester handgun owners must take a gun safety course.

The County Executive heeded Tom’s call to ban gun shows on County property.

Safe Storage

Then County Legislator Tom Abinanti passed today’s Westchester Law that requires gun owners to safely lock away their guns when not in their immediate possession or control – under penalty of a misdemeanor.

A Gun-safety agenda

Tom Abinanti has long championed sensible legislation to reduce gun violence.

His proposals include:
• Trace all guns found in the hands of a minor.
• Require mental health evaluations before any gun purchase can be approved.
• Establish a database of denied firearms purchases and notify domestic violence victims when their abuser attempts to buy firearms.
• Require a firearm safety course/certificate for gun permits statewide.
• Prohibit individuals on the terrorist watch list from obtaining a firearm.
• Prohibit the sale and promotion of firearms on public property.
